Bar Council Publicity Rules 2025/2026: Law Firm Website Compliance
Compliance with Legal Profession Rules 2025: prohibition of touting, approved practice area disclosures, and client confidentiality.
Starting January 1, 2026, the updated Bar Council Publicity Rules govern exactly what Malaysian legal firms can and cannot publish online. Non-compliant law firm websites face severe disciplinary action.
The Prohibition of Touting and Exaggeration
Law firm websites must remain strictly informational. The use of superlatives such as "The Best Law Firm in Malaysia," "Leading Experts," or "100% Success Rate" is strictly prohibited. Your website copy must be audited to remove any language that could be construed as touting or offering a guarantee of success.
Approved Practice Area Disclosures
Firms can only list practice areas in which they have genuine, established competence. The layout of the "Services" or "Practice Areas" page must be objective. When listing lawyer profiles, ensure that only verified qualifications, admissions to the Bar, and relevant experience are displayed.
Client Confidentiality Protocols in Contact Forms
When prospective clients fill out a consultation form on your website, that data must be transmitted securely.
- Enforce TLS 1.3: Ensure your SSL certificates are up to date and legacy TLS protocols are disabled on the server.
- Encrypted Storage: Do not store plain-text case details in your WordPress or CMS database. Use encrypted fields or route form submissions directly to a secure, Bar-compliant CRM system.
